In the course of the past two and a half years, the European Parliament, the European Commission and the High Representative of the Union for Foreign Affairs and Security Policy, and the Council of Ministers have presented strategic documents on the EU's relations with Latin America and the Caribbean (LAC) and the direction they should take in the coming years. This in-depth analysis aims to present the main points of view of the three EU institutions and the Member States on the future of EU-LAC relations. Its second half includes a critical assessment of some aspects of the bi-regional relationship as it has developed in recent years, particularly the institutional links and trade issues, and the challenges it may face in the coming years. Here, the focus is on the political divisions in the LAC region, the uncertainty about regional cooperation and integration and the possible challenges to multilateral policies.

Collectively, the 33 countries forming the Community of Latin American and Caribbean States (CELAC) are the EU's fifth largest trading partner. The EU has fully fledged agreements with two Latin American groupings (Cariforum and the Central America group), a multiparty trade agreement with three countries of the Andean Community (Colombia, Ecuador, and Peru), and agreements with Mexico and Chile that are in the process of being modernised. Collectively, the 33 countries forming the Community of Latin American and Caribbean States (CELAC) are the EU's fifth largest trading partner. The EU has fully fledged agreements with two Latin American groupings (Cariforum and the Central America group), a multiparty trade agreement with three countries of the Andean Community (Colombia, Ecuador, and Peru), and agreements with Mexico and Chile that are in the process of being modernised. Furthermore, the EU has inter-regional and bilateral framework agreements with both Mercosur and its individual members. The EU's agreements governing trade relations with Latin American and Caribbean subgroupings and individual countries differ considerably in terms of coverage and methodology, depending on the time at which they were concluded and the backdrop to the negotiations. The EU is currently modernising the trade pillars of its agreements with Mexico (an 'agreement in principle' was reached in April 2018) and Chile (negotiations are still ongoing) in order to align them to the current standards of EU FTAs. If the EU-Mercosur Association Agreement, which includes a trade pillar for which a political agreement was reached in June 2019, is successfully ratified, the EU would then have comprehensive agreements governing trade relations with nearly all of Latin America and the Caribbean (with the exception of Bolivia, Cuba and Venezuela).

However, most of these fires are set intentionally and are linked to increased human activities in the area, such as the expansion of agriculture and cattle farming, illegal logging, mining and fuel extraction. The Amazon rainforest, which is the largest ecosystem of its kind on Earth and is shared by eight South American countries as well as an EU outermost region, was ravaged by fires coinciding with last summer’s dry season. However, most of these fires are set intentionally and are linked to increased human activities in the area, such as the expansion of agriculture and cattle farming, illegal logging, mining and fuel extraction. Although a recurrent phenomenon that has been going on for decades, some governments' recent policies appear to have contributed to the increase in the surface area burnt in 2019, in particular in Brazil and Bolivia. Worldwide media coverage of the fires, and international and domestic protests against these policies have nevertheless finally led to some initiatives to seriously tackle the fires, both at national and international level – such as the Leticia Pact for Amazonia. Finding a viable long-term solution to end deforestation and achieve sustainable development in the region, requires that the underlying causes are addressed and further action is taken at both national and international levels. The EU is making, and can increase, its contribution by cooperating with the affected countries and by leveraging the future EU-Mercosur Association Agreement to help systematic law enforcement action against deforestation. In addition, as the environmental commitments made at the 2015 Conference of Parties (COP21) in Paris will have to be renewed in 2020, COP25 in December 2019 could help reach new commitments on forests.

On 28 June 2019, the European Union (EU) and the four founding members of Mercosur (the 'Southern Common Market') – Argentina, Brazil, Paraguay and Uruguay – reached an 'agreement in principle' on a free trade agreement (FTA) as part of a wider association agreement (AA). However, spurred by massive destruction of the Brazilian Amazon through large-scale forest fires, EU policy-makers and international environmental groups alike have since become increasingly vocal in expressing concerns about the deal's potential environmental and climate change implications. EU farmers' associations with defensive interests have fiercely criticised what they have referred to as a 'cars for cows' deal. On the other hand, the deal has been warmly welcomed by EU industry associations and several sub-sectors of EU agriculture with offensive interests. If tariff and non-tariff barriers are eliminated or substantially lowered, the potential for growth in bi-regional trade in goods, services and investment is significant. In addition, the FTA would be a strong signal in favour of the rules-based multilateral trading system and against power politics in trade. After the agreement's legal review and translation, it will be presented to the Council for signature. It will then be submitted to the European Parliament for consent. Once the Council has adopted the decision concluding the agreement, it will be presented to EU Member State parliaments for ratification. First edition. This second thematic study in the Peace and Security series focuses on European Union (EU) peace support efforts in Colombia. The series will make an annual evaluation of EU performance in the field of peace and security in a specific geographical region. This study evaluates EU engagement during the 50-year conflict in Colombia, and focuses on peacebuilding since the historic 2016 final agreement between the government and the main armed group, the Revolutionary Armed Forces of Colombia (FARC-EP). This is a country where the EU has mobilised a large spectrum of civilian instruments: bilateral and multilateral diplomacy; humanitarian and development aid; and trade relations. After placing the conflict in its geopolitical context, this evaluation analyses the EU approach to and implementation of support to peace in Colombia, the European Parliament's contribution, risks since the signature of the peace agreement, and ways to mitigate them. A parallel study, published separately, provides an overview of current EU action on peace and security and introduces the 2019 Normandy Index. The studies have been drafted with a view to their presentation at the Normandy World Peace Forum, in June 2019.

Chile is a close partner of the EU in Latin America. The EU and Chile have a mutual interest in pursuing even closer ties, leading them to agree to upgrade and modernise the Association Agreement signed in 2002. They started negotiations on a modernised agreement in November 2017. President Sebastián Piñera's centre-right government took office in March 2018. Politically, the situation of the Mapuche indigenous community and stricter migration policies have dominated its first year. The government has also tabled comprehensive proposals for tax and pension reform but has found it difficult to implement its reform programme. This is largely because it lacks a majority in Congress and faces a much more diverse political landscape than in the past, making it more difficult to gain broad support for its proposals. However, it has benefited from a robust economic recovery that started in 2018 after two years of sluggish growth. Under President Piñera, Chile has adopted a tough stance against the Venezuelan government, in line with other centre-right governments in South America. Chile played a key role in the launch in March 2019 of the new organisation for regional cooperation, the Forum for the Progress of South America (Foro para el Progreso de América del Sur, PROSUR).

The meaning of 'association' under EU law - A study on the law and practice of EU association agreements

This study, commissioned by the European Parliament’s Policy Department for Citizens’ Rights and Constitutional Affairs at the request of the AFCO Committee, analyses the law and practice of EU association agreements. It maps out different types of association agreements concluded on the legal basis of Article 217 TFEU and identifies the key features characterising the nature of association under EU law.
