The European Commission package of ETIAS consequential amendments: Substitute impact assessment

On 7 January 2019, the European Commission presented two proposals for amendments to the legal instruments of the EU information systems following the adoption of Regulation 2018/1240 on the establishment of a European Travel Information and Authorisation System (ETIAS). On 7 January 2019, the European Commission presented two proposals for amendments to the legal instruments of the EU information systems following the adoption of Regulation 2018/1240 on the establishment of a European Travel Information and Authorisation System (ETIAS). The ETIAS Regulation requires all visa-exempt non-EU nationals to apply online for travel authorisation prior to the date of their departure. Neither the original Commission proposal for ETIAS, nor the two subsequent proposals (‘the Commission package’) were accompanied by Commission impact assessments. The European Parliament’s Committee on Civil Liberties, Justice and Home Affairs (LIBE) therefore requested a targeted substitute impact assessment of the expected fundamental rights impacts of specific elements of the Commission package. In particular, this study assesses: 1) whether the amendments to the ECRIS-TCN Regulation provided for in the Commission package extend the scope of that information system and, if so, whether such an extension is necessary and proportionate in accordance with Article 52(1) of the EU Charter; and 2) whether the amendments regarding the automated processing of ETIAS application files through comparisons against data present in EU information systems raise concerns in relation to the rights to respect for private life and protection of personal data.

El galardonado con el Premio Sájarov 2019 es un reputado profesor de economía uigur, Ilham Tohti, defensor moderado de los derechos de la minoría uigur y del diálogo con la mayoría han en China. En 2014 fue condenado a cadena perpetua acusado de cargos relacionados con el separatismo, en un contexto de endurecimiento por parte de China de la política de lucha contra el extremismo religioso, el separatismo étnico y el terrorismo, que en la actualidad señala a la identidad uigur como una importante amenaza para la seguridad nacional. El Premio Sájarov está dotado con 50 000 euros, y se presentará en una ceremonia que tendrá lugar en el Parlamento Europeo durante la sesión plenaria de diciembre en Estrasburgo, en presencia de los demás finalistas.

Certain goods and technologies have legitimate civilian applications but can also be used for military purposes; so-called 'dual-use' goods are subject to the European Union's export control regime. The regime is now being revised, mainly to take account of significant technological developments and to create a more level playing field among EU Member States. The proposed regulation would recast the regulation in force since 2009. Among other elements, the proposal seeks to introduce an 'autonomous' EU list for cyber-surveillance technology featuring items that are not (yet) subject to multilateral export control. Moreover, the proposal seeks to introduce human rights violations as an explicit justification for export control. Stakeholders are divided over the incorporation of human rights considerations, with the technology industry particularly concerned that it might lose out to non-European competitors. On 17 January 2018, based on the INTA committee's report on the legislative proposal, the European Parliament adopted its position for trilogue negotiations. For its part, the Council adopted its negotiating mandate on 5 June 2019, and on the basis of this mandate, the Council Presidency began negotiations with the European Parliament's delegation on 21 October 2019.
