A cooperação judiciária em matéria penal baseia-se no princípio do reconhecimento mútuo das sentenças e decisões judiciais e inclui medidas para aproximar as legislações dos Estados-Membros em diversos domínios. O Tratado de Lisboa passou a fornecer uma base mais forte para o desenvolvimento de um espaço de justiça penal, consagrando novos poderes para o Parlamento Europeu.
Cooperação policial
O principal instrumento desta cooperação policial é o Serviço Europeu de Polícia (Europol), que é um aspeto central da arquitetura geral da segurança interna europeia. A cooperação e as políticas estão ainda em fase de desenvolvimento, focando a atenção na tarefa de combater de forma mais eficaz as ameaças pan-europeias e a criminalidade e – em especial para o Parlamento – em fazê-lo em conformidade com os direitos fundamentais e as regras de proteção de dados.
