Svoboda gibanja in bivanja oseb v EU je temelj državljanstva Unije, uvedenega z Maastrichtsko pogodbo leta 1992. Po tem, ko so bile notranje meje v skladu s schengenskimi sporazumi postopoma odpravljene, je bila sprejeta Direktiva 2004/38/ES o pravici državljanov EU in njihovih družinskih članov do prostega gibanja in prebivanja v EU.
