Implications of the Digital Transformation on Different Social Groups EN

Resumen : This study, commissioned by the European Parliament’s Policy Department for Citizens’ Rights and Constitutional Affairs at the request of the PETI Committee, analyses the impact of digitalization on vulnerable social groups in terms of lower income and education, age, people affected by disabilities, minority ethnic groups and people living in remote/isolated geographic areas. It includes a review of the relevant academic literature, secondary data analysis, as well as three case studies focused on digital inequality in e-commerce and digital financial services. The study reviews the EU legislations relevant in the policy areas that are the object of the case studies and elaborates some recommendations on the actions that the EU could undertake to tackle the digital divide affecting vulnerable social groups.

Introducing a European disability card and a European parking card EN

Resumen : The IA supporting the proposal for a European disability card and a European parking card builds on the experience of two instruments already in place: i) the EU disability card pilot project rolled out in eight participating Member States since 2016, and ii) the EU parking card for persons with disabilities, introduced EU-wide in 1998 through Council Recommendation 98/376/EC. The IA draws on a wide range of data, including a supporting study (which, however, is not linked and does not seem to have been published) and a recent study assessing the implementation of the disability card pilot project. The IA presents a clear and comprehensive intervention logic. It puts forward two policy options in addition to the baseline scenario, duly analysing the potential impacts, with a focus on social, fundamental rights and economic impacts. Stakeholder input was taken into account throughout the IA. Disability organisations were involved in the consultations; in addition, in line with the UN CRPD and the BRG, the open public consultation included accessible formats (e.g. a questionnaire in easy-to-read format). The legislative proposal broadly follows the IA, with some minor differences regarding the scope, delegated acts and review clauses.

Resumen : This study, commissioned by the Policy Department for Citizens’ Rights and Constitutional Affairs at the request of the Committee on Petitions (PETI), demonstrates the need to change systems that respond to homelessness as an issue of individual dysfunction and inadequacy, to systems that end homelessness. The residential instability felt by the majority of those who are homeless needs to be addressed through the provision of integrated housing, welfare, and health services. Public policy should aim to prevent homelessness in the first instance. For those who experience homelessness, the duration must be minimised by rapidly providing secure, affordable housing, in order to reduce further experiences of homelessness, decrease costly emergency accommodation, and alleviate trauma associated with homelessness.

Resumen : This study, commissioned by the European Parliament’s Policy Department for Citizens’ Rights and Constitutional Affairs at the request of the Committee on Petitions (PETI), analyses the kinds of compensation available to victims of climate change disasters in the EU. The study outlines the dangers and effects of climate change in the EU as well as the EU policies and mechanisms to deal with climate change disasters. A theoretical framework is developed to determine appropriate compensation mechanisms to deal with climate change disasters. Also, the compensation mechanisms for natural disasters in a representative selection of Member States are discussed. Furthermore, a critical analysis of the compensation mechanisms at EU and Member State level is provided, and policy recommendations are formulated.

Minority and minoritised languages as part of the European linguistic and cultural diversity EN

Resumen : This study, commissioned by the European Parliament’s Policy Department for Citizens’ Rights and Constitutional Affairs, at the request of the PETI Committee, inquires about the connection between the “Protection of European linguistic and cultural diversity” and the “Protection and promotion of European minority and minoritised languages” in Europe. The situation of the European minority and minoritised languages can be seen as a barometer of the current state of European linguistic and cultural diversity. The available data show that more than two thirds of linguistic minorities within the European Union have significantly decreased in number in recent decades (1991-2011). At the pan-European level, too, two thirds of minorities have declined over the same period. The same must be assumed as to the use of the languages spoken by these minorities. Some positive cases – all located in the European Union – show, however, that there are exceptions to this general trend and that there are indeed possibilities, with which the paper deals, for the successful protection and promotion of minorities and their languages, thus enhancing the linguistic and cultural diversity of Europe.

Resumen : Over the past years, the European Parliament’s Committee on Petitions (PETI) has received several petitions by citizens concerning the effects of climate change. PETI has therefore requested the Policy Department for Citizens’ Rights and Constitutional Affairs to organise a Workshop on: “The impact of climate change on social security and the most vulnerable groups”. In particular for vulnerable groups such as children, the elderly, persons with disabilities and low-income groups, new directions in social security and health policies need to be explored to protect them from the impacts of climate change. One very important field of research for objectively assessing the effects of climate change is “attribution science”. It seeks to test whether — and by how much — climate change may be responsible for certain extreme weather events, such as droughts, extreme flooding, hurricanes, excessive heat or odd storm trajectories. The briefing, presented at the Workshop, explains what attribution science is and provides (policy) recommendations on how the impacts of climate change on social security and vulnerable groups can be mitigated, i.a. with the knowledge obtained in the field of attribution science.

Resumen : Recent developments within the framework of the European Green Deal have aimed at criminalization and an overhaul of regulatory frameworks to address environmental crime and its effects on the financial interests of the EU. This document was prepared by the Policy Department for Citizen’s Rights and Constitutional Affairs at the request of the Committee of Petitions. The study suggests that despite commendable efforts, the transnational nature of environmental crime and its convergence with organized crime, money laundering and corruption, have not been adequately integrated into current reforms. A proper categorization of environmental crime as a ‘serious crime’ is needed as an essential basis for policy reforms.

Resumen : Linking national spending on the environment with the effects it has on the environmental performance of EU Member States allows for a better assessment of the effective quality of budgetary interventions. In this analysis, based on the detailed research paper in the Annex, we discuss under what circumstances some public environmental expenditure could be spent more efficiently at EU rather than at national level. We estimate that this transfer towards a more efficient level of governance would allow Member States to save between €20 billion and €26 billion of budgetary spending per year. In the present exacerbated economic, social and environmental crisis, we conclude that reducing budgetary waste and improving the way public money is spent should be fully integrated to achieve more sustainable development.

Resumen : Este estudio, encargado por el Departamento Temático de Derechos de los Ciudadanos y Asuntos Constitucionales del Parlamento Europeo a solicitud de la Comisión de Peticiones, tiene como objetivo conocer con más detalle los aspectos jurídicos de la explotación forestal ilegal y el comercio relacionado con la madera y los productos de la madera obtenidos de forma ilegal. En él se analizan los requisitos jurídicos y sus implicaciones para los distintos actores de la UE y de terceros países. En este estudio se examinan las disparidades de los regímenes de aplicación y sancionadores de los Estados miembros y analiza su papel en la desviación del comercio. Se explora además la posibilidad de reforzar el régimen de la madera ampliando el ámbito del mismo y abordando cuestiones subyacentes como la corrupción y las violaciones de los derechos humanos. También evalúa la dimensión externa, con especial atención a los acuerdos voluntarios de asociación con los principales países productores. En el estudio se formulan varias recomendaciones para mejorar el régimen teniendo en cuenta las dimensiones interna y externa de la explotación forestal ilegal.

It presents an analysis of the EU right to petition, as a key element of participatory democracy, and its procedure with a focus on the cooperation between the Committee on Petitions and the Commission. It examines the procedures to deal with petitions and infringements of EU law, in particular EU environmental law. It provides an overview of key features of national petition systems in relation to the EU system and proposes recommendations for action by the EP and the Commission to improve the way petitions are handled.

Resumen : Este estudio lo solicitó la Comisión de Peticiones del Parlamento Europeo (PETI) en respuesta a la Iniciativa Ciudadana Europea (ECI) «End the Cage Age» (El final de la época de las jaulas). La petición «End the Cage Age» (www.endthecageage.eu) la inició en 2018 Compassion in World Farming y otras 170 organizaciones y ciudadanos europeos que abogan por la protección y el bienestar animal. A lo largo de un año, se recogieron 1,4 millones de firmas verificadas de ciudadanos de 28 Estados miembros de la UE, y se entregaron el 2 de octubre de 2020. A lo largo de los años, la Comisión de Peticiones ha recibido un número considerable de peticiones sobre bienestar animal.

Resumen : Este estudio, encargado por el Departamento Temático de Derechos de los Ciudadanos y Asuntos Constitucionales del Parlamento Europeo a petición de la Comisión de Peticiones (PETI), se centra en el uso generalizado de plásticos y revisa el consenso creciente respecto a los posibles impactos ecotoxicológicos de estos materiales, en especial de las partículas plásticas más pequeñas, denominadas microplásticos. Se examinan posibles estrategias de mitigación encaminadas a reducir la prevalencia de los (micro)plásticos, así como las alternativas emergentes y su idoneidad medioambiental. En los últimos años, debido al impulso generado por una concienciación cada vez mayor respecto a los impactos de los plásticos y por la opinión pública, se han propuesto y ejecutado multitud de normas, reglamentos, leyes y recomendaciones. Estas varían enormemente en las distintas escalas local, nacional, regional e internacional, y no está claro cuáles son los efectos beneficiosos de estas herramientas. En este estudio se evalúan estos instrumentos existentes, se analiza si se basan en datos científicos sólidos, y se examinan los retos previsibles que podrían limitar la pertinencia e idoneidad de las propuestas legislativas presentes y futuras.

Resumen : The PETI Committee decided to organise a fact-finding visit to Bulgaria as a result of a relatively large number of petitions it has received from Bulgarian citizens on the Bulgarian Code of Civil Procedure (CCP). Petitioners allege breaches of consumer rights, corruption, the role of bailiffs, violation of the right to a fair trial, and breaches of Directive 93/13/EEC on unfair terms in consumer contracts. The aim of the visit is to hear the petitioners and to investigate and discuss the subject matter of the petitions with the Bulgarian authorities.

Logros de la Comisión de Peticiones durante la legislatura 2014-2019 y retos para el futuro

Resumen : Durante la legislatura 2014-19, la Unión y, en particular, el Parlamento Europeo, a través de su Comisión de Peticiones (PETI), ha seguido defendiendo el derecho de los ciudadanos a presentar peticiones al Parlamento Europeo para plantear cuestiones y preocupaciones y pedir reparación y medidas en ámbitos de competencia de la Unión, movilizando a las instituciones y a los Estados miembros tanto en relación con las cuestiones que ocupan un lugar central en el debate político como con las cuestiones «huérfanas» o «latentes». Con el fin de servir mejor a los ciudadanos de la Unión, la comisión ha desarrollado un Portal de Peticiones para facilitar la presentación de peticiones y aumentar la interacción y los servicios de información. Adoptó directrices nuevas y actualizadas para facilitar la tramitación de las peticiones y el proceso de toma de decisiones de la comisión. También ha conseguido introducir algunos cambios positivos en el Reglamento interno del PE. La cooperación con otras comisiones del PE fue reforzada y mejorada, en particular a través de la creación de una Red de Peticiones. Por primera vez, la Comisión PETI creó un grupo de trabajo especial, el Grupo de Trabajo sobre Asuntos Relativos al Bienestar Infantil, que era responsable de investigar una serie de peticiones sobre los derechos de los niños y de informar a la comisión por medio de recomendaciones. La Comisión PETI mantuvo buenas relaciones laborales con la Comisión, el Consejo, los Estados miembros y el Defensor del Pueblo Europeo. Trabajó en estrecha colaboración con los servicios del PE, en particular con el Servicio Jurídico del Parlamento Europeo, y aumentó exponencialmente el uso de la experiencia de investigación del Departamento Temático de Derechos de los Ciudadanos y Asuntos Constitucionales para estudios y talleres, así como del EPRS. Además, en la legislatura 2014-2019, organizó un gran número de audiencias públicas. A su vez, la comisión consiguió mantener la actividad parlamentaria global notablemente estable al comparar el número de informes, opiniones, preguntas orales, resoluciones y visitas de información realizadas durante las legislaturas 2014-2019 y 2009-2014 (véase el anexo 1). En este contexto, la Comisión PETI siguió examinando un gran número de peticiones que planteaban problemas en todos los ámbitos de actividad de la Unión: derechos fundamentales, migración, derecho de petición, ciudadanía, libre circulación, discriminación, Iniciativa Ciudadana Europea; derechos del niño, medio ambiente, bienestar de los animales, discapacidad, política social y empleo, Brexit, mejora de la legislación y aplicación de la legislación de la Unión, apertura, transparencia, acceso a los documentos, conflictos de intereses, y acuerdos internacionales. La Comisión PETI también trató algunos temas muy específicos, por ejemplo, la legislación hipotecaria y los instrumentos financieros de riesgo. Debido a su importante papel en la detección de violaciones de los derechos de las personas con discapacidad (la llamada «función de protección» dentro del marco de la Unión establecido para aplicar la Convención de las Naciones Unidas sobre los Derechos de las Personas con Discapacidad a escala de la Unión y de los Estados miembros), la Comisión PETI ha dedicado mucha atención al tema de la discapacidad.
