Delegacja Prawa i Sprawiedliwości w sprawie sprawozdania rocznego z funkcjonowania strefy Schengen wstrzymała się od głosu. To pierwsze obowiązujące sprawozdanie, w ramach którego Parlament poddaje ściślejszej kontroli oceny półroczne przyjęte przez Komisję. Raport dokonuje ewaluacji implementacji mechanizmu oceny strefy Schengen.
Raport słusznie potępia notoryczne przedłużanie przez państwa członkowskie kontroli na granicach wewnętrznych, uzasadniane kwestiami bezpieczeństwa wewnętrznego bez przedstawienia konkretnych wiążących argumentów/dowodów/analiz, że takie kontrole są konieczne, niezbędne i proporcjonalne, co powoduje, że „wyjątki stają się regułą”, w konsekwencji utrudniając wolny przepływ pomiędzy państwami członkowskimi.
Pozytywnie należy ocenić wskazanie w raporcie możliwości wykorzystania innych alternatywnych środków, które nie będą miały takiego społecznego oddziaływania jak przywracanie kontroli na granicach wewnętrznych. Raport pozytywnie odnosi się także do potrzeby określenia jasnych i klarownych procedur w zakresie procedowanych zmian w Kodeksie Granicznym Schengen w przedmiocie kontroli na granicach wewnętrznych, mając na względzie zachowanie zasady swobody przemieszczania się oraz możliwe ekonomiczne konsekwencje.
Negatywne należy uznać powiązania właściwego funkcjonowania Schengen z kwestiami migracyjno-azylowymi, w tym z koniecznością zawarcia kompromisu politycznego dotyczącego propozycji dublińskiej. Ponadto raport odnosi sprawne funkcjonowanie Schengen do tzw. holistycznego podejścia do imigracji opierającego się na konieczności rozwoju zdolności recepcyjnych oraz integracyjnych państw członkowskich do przyjmowania migrantów, a także intensyfikowania dróg legalnego wjazdu do UE.
