Volný pohyb kapitálu se stal nejen nejnovější svobodou zakotvenou ve Smlouvě, ale rovněž svobodou s nejširší působností – vztahuje se totiž i na třetí země. Liberalizace pohybu kapitálu se postupně zvyšovala. Maastrichtská smlouva zrušila jakékoliv omezení pohybu kapitálu a plateb jak mezi členskými státy, tak se třetími zeměmi. Tato zásada má přímý účinek, tj. nevyžaduje žádné další právní předpisy ani na úrovni EU, ani na úrovni členských států.
