Der wirtschaftliche Erfolg und die massive Nutzung der Dienstleistungen von Unternehmen wie Uber stellen die Regulierungsbehörden in den Vereinigten Staaten und in der Europäischen Union vor eine Reihe von Fragen. Die wichtigste Frage dabei ist, ob derartige Online-Anwendungen oder -Plattformen ihren Erfolg ausschließlich Innovationen verdanken, oder ob dieser vielmehr auf der Ausnutzung von Gesetzeslücken basiert. Bürger und Verbraucherorganisationen fragen sich, ob die Reaktionen der Behörden auf diese innovativen Dienstleistungen von echten Befürchtungen in Bezug auf eine angemessene Regulierung von Beförderungsleistungen und Verbrauchersicherheit geleitet sind oder ob damit die herkömmlichen, auf dem Markt etablierten Verkehrsunternehmen geschützt werden sollen.

Civil Judicial Experts in Cross-Border Litigation: Towards the ‘European Judicial Expert’

Upon request by the JURI Committee, this in-depth analysis examines the rules applicable to judicial experts in the Czech Republic as well as the possibilities of establishing a list of European experts in the EU. Upon request by the JURI Committee, this in-depth analysis examines the rules applicable to judicial experts in the Czech Republic as well as the possibilities of establishing a list of European experts in the EU. Judicial expertise in cross-border litigation in the Czech Republic may be performed only by experts registered in a special national public directory. The existing European legal standards do not provide any satisfactory solution for cooperation between the courts and an expert from another Member State. The solution lies in unification of the basic standards for selection of an expert as well as the processing of the expert opinion. It will then be possible to establish a single list of European experts, which would be based on the harmonised national lists.

In the twenty years since independence the development of free media in Croatia, alongside the birth of democracy and introduction of the market economy, has been a huge challenge. During the 1990s state censorship of the media continued to prevail. Since then the state of media freedoms has improved, but serious problems remain. This paper reviews the present state of affairs in the following four areas: (i) legal framework of the media, (ii) their ownership and financial situation, (iii) the freedom of the media and (iv) the role of the media in the fight against organized crime and corruption. While further amendments of media legislation are required to meet EU standards, the media are already showing themselves to be potent forces in the struggle against the wider problem of state corruption and its defective judiciary. The EU accession process is a unique opportunity to achieve decisive progress in these respects.
