EU policies – Delivering for citizens: Protecting European consumers

Consumer protection rules have been improving the rights of consumers in the European Union since the 1970s. While the level of protection is today considered to be among the highest in the world, consumers in the EU are still faced with a number of issues. According to the latest available data, in 2016 one in five consumers said that they had had a reason to complain in the last 12 months, a level which has remained largely unchanged since 2008. Since 2014, efforts have been made in a number of areas, including stronger cross-border cooperation between national authorities in charge of consumer protection and market surveillance. Notably, the Commission proposed a 'new deal for consumers' in April 2018, to enable representative legal actions for the protection of the collective interests of consumers and to modernise EU consumer protection rules. Sector-specific efforts included: eliminating roaming charges across the EU in 2017; legislation aimed at facilitating consumer participation in the digital single market; reforms on the rules on privacy and data protection; enhancing the rights of energy consumers and passengers; and efforts to address the 'dual quality' of branded food products. The EU budget for consumer protection is relatively small, because although rules in this field are made at the EU level, their implementation and enforcement are carried out by the Member States. The consumer programme has a budget of €188 million for the 2013-2020 period, or roughly €0.05 per citizen per year. This may change in the new multiannual financial framework, as consumer protection becomes part of a wider single market programme, which is expected to create synergies between its various components. Future policies could focus on longer product lifetime, labelling and quality requirements for non-agricultural and industrial products, fairer food labelling and retail financial services. This is an update of an earlier briefing issued in advance of the 2019 European elections.

On 11 April 2018, the European Commission published a proposal to review the General Food Law Regulation and amend eight legislative acts dealing with specific food chain sectors. The proposal follows-up on the European Citizens' Initiative on glyphosate; and especially on concerns regarding the transparency of the scientific studies used in the evaluation of pesticides. The proposal also responds to a fitness check of the General Food Law, completed in January 2018. The proposal's objective is to increase the transparency and sustainability of the EU scientific assessment model, and other aspects such as governance of the European Food Safety Authority (EFSA). In the European Parliament, the Committee on the Environment, Public Health and Food Safety (ENVI) adopted its report on 27 November 2018. A vote in plenary to finalise Parliament's position took place on 11 December and the Council adopted its position on 12 December 2018. A provisional agreement was reached at the third trilogue meeting on 11 February 2019, and was endorsed in the ENVI committee on 20 February. The text will be the subject of a vote to adopt it in plenary in the coming weeks. Second edition. Mandatory origin-labelling schemes in Member States

The regulatory basis for these national measures is the Regulation on the provision of food information to consumers, which allows Member States to adopt additional national measures concerning the mandatory labelling of foodstuffs, as long as these are justified by reasons specifically defined in the regulation. The European Parliament has been supporting origin labelling in several resolutions. Consumer organisations have advocated it as well, while many industry stakeholders have highlighted the practical difficulties and costs it would bring. The European Commission has reiterated its position, based on its reports exploring the issue, that voluntary origin labelling is the best option at European level.

The aim of this study is to illustrate the different ways in which the current EU legislative framework may be affected by the digitisation and automation of farming activities and the respective technological trends. The study analyses the issues that might have to be dealt with, identifying the European Parliament committees concerned and the legislative acts that might need to be revisited, especially in view of the forthcoming Commission communication on the future of the Common Agricultural Policy (CAP). It also provides a series of overarching recommendations that EU actors may wish to take into account when dealing with precision agriculture. To do so, an analysis of the multiple ethical and legal challenges associated with precision farming technologies has been performed, along with a scanning of current legislation in a wide range of areas of EU policy-making, including agricultural policy and related fields, such as environment, health, food safety and climate change.

The term includes both plant protection products (used on plants in agriculture, horticulture, parks and gardens) and biocidal products (used in other applications, for example, as a disinfectant or to protect materials). Pesticides can be useful in a number of circumstances, for example, in overcoming diseases and increasing agricultural yields. However, they are not without their disadvantages – above all, their environmental impact, the risks that they pose to human health and their effects on crop protection. European Union pesticide legislation is designed to ensure a high level of protection for human health and the environment and to improve the functioning of the internal market. Plant production products and biocides are subject to a dual approval process: active substances are approved at EU level and products are subsequently authorised predominantly at Member State level. Furthermore, standardised maximum levels are set for the residues of plant protection products in food, and a framework for action is focused on sustainable pesticide use. A number of aspects of European Union policy on pesticides can be considered as either opportunities or challenges, in particular, issues surrounding costs for the industry, the approval process, and sustainability. The Commission is currently assessing the legislation on plant protection products and their residues. The conclusions of that study are expected by the end of 2018.
