On 1 July 2018, as part of the work on the EU's 2021-2027 multiannual financial framework, the European Commission proposed a package of three regulations with the aim of reshaping and modernising the common agricultural policy (CAP). One of these proposals, the Amending Regulation, introduces changes to rules governing the common market organisation (CMO) in agricultural products (including the rules on wine), the EU quality schemes (geographical indications) and the support measures for remote regions. The aim is to equip agricultural markets and support measures to face new challenges, update provisions, simplify procedures and ensure consistency with other regulations on the future CAP.

The quality of European agricultural products often relies on their geographical origins, the traditional recipes used to make them, and the methods used in production and processing. These human and geographical factors are intrinsic to making a product unique. In 1992, the EU developed a quality scheme for foodstuffs, including the designation of their origin. The objectives of the EU quality scheme are to provide consumers with clear information, allowing them to make a more informed choice, and to indicate the added value of a given product. The protection of European local and gastronomic traditions, especially against imitation in third countries, is another important aim of the regulations. Consequently, the EU's engagement in protecting its registered products on the global market is a contentious issue in the negotiation of many trade agreements.

In connection with the next reform of the CAP post 2020, the Commission has proposed a new Regulation (COM(2018)394 of 1 June 2018) on the common market organisation, amending Regulation (EU) No 1308/2013 of 13 December 2013 (amended by Regulation (EU) No 2017/2393 of 13 December 2017). This draft regulation does not, however, cover questions on the relationship between the CAP and competition; the proposal does not contain any provisions concerning the responsibilities of professional and interbranch organisations and the possible conditions of their submission to competition rules. The recent Omnibus Regulation (EU) No 2017/2393 has made changes to the legal framework for the application of competition rules to the agreements and practices of farmers and their associations. However, this new legislative framework is not yet entirely consistent and, in the light of the Court of Justice judgment handed down on 14 November 2017 in the Endive case, the progress ought to be consolidated and clarified in order to guarantee the real effectiveness of these provisions and greater legal certainty for operators. This study analyses the development of the relationship between the CAP and the competition rules and highlights the need to take corrective action with respect to current farming legislation to ensure that the CAP has primacy over the competition rules and the implementation of the objectives set out in Article 39 of the Treaty.

This study resulted in the identification of four main future opportunities and concerns regarding precision agriculture (PA), or precision farming, in the EU, on which the European Parliament could take anticipatory action now: 1.  PA can actively contribute to food security and safety; 2.  PA supports sustainable farming; 3.  PA will trigger societal changes along with its uptake; 4.  PA requires new skills to be learned. The wide diversity of agriculture throughout the EU, regarding particularly farm size, types of farming, farming practices, output and employment, presents a challenge for European policy-makers. European policy measures therefore should differentiate between Member States, taking into account that the opportunities and concerns vary highly from one country to another.

In light of the challenges currently facing the agriculture sector in the EU, an effective promotion policy becomes an important instrument in helping European agriculture to compete on world markets. Given the contribution the agri-food sector makes to total EU exports, it is essential for it to improve its competitiveness and market share. To support this objective, a new promotion policy for EU agricultural products has been developed, applicable since 1 December 2015. Based on a new Regulation, the policy introduces significant changes to the EU's information provision and promotion measures. These include an increased annual budget of up to €200 million by 2019, a greater focus on third countries; simplification, an expansion in the scope of measures to allow labelling to specify the origin of products and their brands under certain conditions, easier management of multi-country programmes and an expansion in the scope of eligible products and eligible beneficiaries. The key elements of the new policy are presented alongside details of the main administration and delivery mechanisms including its work programme for 2016. The latter sets out the priorities accorded to promotion activities for both the internal market and for those third countries where there is the highest potential for growth. The first calls for proposals under the new rules closed at the end of April 2016. Though it is too soon to examine the outcome of the 2016 call, it is possible to provide evidence on the potential impact that might be expected from agricultural information and promotion programmes.

This note seeks to provide an initial analysis of the strengths and weaknesses of the European Commission's Impact Assessment accompanying its proposal for a Regulation of the European Parliament and of the Council on information provision and promotion measures for agricultural products on the internal market and in third countries (COM (2013) 812 final which was submitted on 21 November 2013. It analyses whether the principal criteria laid down in the Commission’s own Impact Assessment Guidelines, as well as additional factors identified by the Parliament in its Impact Assessment Handbook, appear to be met by the IA. It does not attempt to deal with the substance of the proposal. It is drafted for informational and background purposes to assist the relevant parliamentary committee and Members more widely in their work.
