Resettlement of refugees: EU framework

Resettlement is one tool to help displaced persons in need of protection reach Europe safely and legally, and receive protection for as long as necessary. It is a durable solution which includes selection and transfer of refugees from a country where they seek protection to another country. Apart from providing international protection to refugees, its aim is also to strengthen solidarity and responsibility-sharing between countries. For a resettlement to take place, the United Nations Refugee Agency (UNHCR) has to determine an applicant is a refugee according to the 1951 Geneva Convention, and has to identify resettlement as the most appropriate solution. On 13 July 2016, as part of the reform of the Common European Asylum System and the long-term policy on better migration management, the Commission presented a proposal which aims to provide for a permanent framework with standard common procedures for resettlement across the EU, and will complement current national and multilateral resettlement initiatives. Although a partial provisional agreement on the proposal was reached between the Parliament and Council in summer 2018, the Council has been unable to endorse that, nor agree on a mandate for further negotiations.

Entering the EU as a non-European is not too difficult for people from stable countries. Those planning to visit one or more EU Member States can get in as a tourist, with or without a visa. If the intention is to live and work for a longer period, they can use the many possibilities offered by labour migration. Regular mobility schemes also include provisions for other categories such as students, researchers, au pairs and voluntary workers. People wishing to join a family member who is already residing legally in the EU might even be eligible for family reunification. However, for people coming from countries at war or where democracy is in serious peril, or who happen to live in a non-EU country after fleeing their own country, or who are simply looking for a better life, the options are more limited. Moreover, even when options exist, gaining access to them is not always possible for people who find themselves in precarious, dangerous or even life-threatening situations. In 2015, a record number of people tried to reach Europe by all means, often risking their lives along their journeys. Although the number of irregular arrivals in the EU is back to pre-crisis levels, immigration remains one of the key concerns of European citizens and is expected to remain a challenge for years to come. In order to address this challenge, the EU has embarked on a process of reform aimed at rebuilding its common asylum policies on fairer and more solid ground, strengthening its external borders by reinforcing the links between border controls and security, and renewing cooperation with third countries on migration issues. A forward-looking and comprehensive European immigration policy, based on solidarity and respect for European values, requires a balanced approach to dealing with both irregular and legal migration. The EU is committed to help create more, safe and controlled channels to migration both to help people in need of protection and to address labour market needs and skills shortages adequately.

El objetivo es permitir una comprobación más exhaustiva de los antecedentes de los solicitantes de visado, colmar las lagunas de información en materia de seguridad mediante un mejor intercambio de información entre los Estados miembros, y garantizar la plena interoperabilidad con otras bases de datos a escala de la Unión. Se prevé que el Parlamento someta a votación su posición sobre dicha propuesta durante su período parcial de sesiones de marzo I.

There are opportunities for cooperation in the field of border management, migration and refugee protection among member states of the Union for the Mediterranean (UfM) during the European Parliament’s presidency of the Parliamentary Assembly of the Union for the Mediterranean (PA-UfM). There needs to be greater trust and confidence among these states in order to achieve such objective. UfM member states participate in a range of related initiatives in their various regions with states outside the UfM. These need to be accommodated. UfM member states share an international legal basis applicable to the field which may usefully be built upon. UfM member states widely affirmed political commitment to this foundation in the 2018 UN Global Compact for Safe, Orderly and Regular Migration and its counterpart for Refugees.

This initial appraisal of the Commission’s impact assessment on the proposals acknowledges the necessity for impact assessments in relation to financial framework programmes to have a simplified format and scope differing from standard impact assessments and that the document in question sets out the rationale for the new instruments and explains the choices made in their design. It finds however that the level of analysis conducted and the measure of the departure from the standard methodology and format of impact assessments weaken its potential to inform decision-making.

We also offer recommendations on how to improve the use of funds and allocation keys to Member States. We argue for an increase in funding in support of member states as well as for EU agencies such as Frontex and EASO and for a more strategic coordination of various migration related initiatives.

Senegal: bastion of democracy, migration priority for the EU

Senegal is one of the most politically stable countries in Africa. Free and fair presidential elections in March 2012, for which the EU deployed an Election Expert Mission (EEM), brought Macky Sall to the presidency. The regular organisation of legislative elections, political pluralism, a free press, and a vibrant civil society are all proof of Senegal's democratic culture. Senegal is one of the most politically stable countries in Africa. Free and fair presidential elections in March 2012, for which the EU deployed an Election Expert Mission (EEM), brought Macky Sall to the presidency. The regular organisation of legislative elections, political pluralism, a free press, and a vibrant civil society are all proof of Senegal's democratic culture. Senegal has a long tradition of migration to the EU and other African countries, and today 5 % of its population live abroad. Remittances account for more than 10 % of GDP. As a priority partner in the Migration Partnership Framework, Senegal has been constructive in the political dialogue on migration, while maintaining its position that more should be done on legal migration into the EU. Senegal is one of the main benificiaries of the EU Trust Fund. Development cooperation, still at the core of relations with Senegal, has been structured to ensure increased coordination between the EU, Member States, and the Senegalese authorities. The challenge going forward will be to ensure that Senegal honours its commitments on the readmission of irregular migrants, and encourage progress on human rights.

It examines the scheme in the context of the Dublin System, the hotspot approach, and the EU-Turkey Statement, recommending that asylum seekers’ interests, and rights be duly taken into account, as it is only through their full engagement ...

This study, commissioned by the European Parliament’s Policy Department for Citizens' Rights and Constitutional Affairs at the request of the LIBE Committee, examines the EU’s mechanism of relocation of asylum seekers from Greece and Italy to other Member States. It examines the scheme in the context of the Dublin System, the hotspot approach, and the EU-Turkey Statement, recommending that asylum seekers’ interests, and rights be duly taken into account, as it is only through their full engagement that relocation will be successful. Relocation can become a system that provides flexibility for Member States and local host communities, as well as accommodating the agency and dignity of asylum seekers. This requires greater cooperation from receiving States, and a clearer role for a single EU legal and institutional framework to organise preference matching and rationalise efforts and resources overall.
