In their attempt to contain the COVID-19 pandemic, many countries around the world have imposed limitations on freedom of movement and other related freedoms within their territories, thereby severely curtailing certain fundamental rights. In the event of a public emergency, international human rights norms do allow for the imposition of limitations under strict conditions. Moreover, so far no other approach has been as effective in slowing down the outbreak, while also upholding the right of the most vulnerable to health and life. However, some governments may be abusing the situation to suppress human rights and wield undue power.

Le terme Holocauste désigne l’assassinat de six millions de Juifs européens, ainsi que de Roms et de membres d’autres groupes sociaux destinés condamnés à l’anéantissement par le régime nazi et ses collaborateurs. Le régime nazi mit en place dès 1933 une politique de spoliation, de discrimination d’État et de persécution des Juifs, puis de pogroms et de déportation de masse vers des camps de concentration. Cette politique fut ensuite étendue à tous les territoires et États qu’il dominait en Europe ...

Le régime nazi mit en place dès 1933 une politique de spoliation, de discrimination d’État et de persécution des Juifs, puis de pogroms et de déportation de masse vers des camps de concentration. Cette politique fut ensuite étendue à tous les territoires et États qu’il dominait en Europe pendant la Seconde Guerre mondiale. Les exécutions sommaires de masse («Shoah par balles») et les camps d’extermination en furent l’aboutissement. Les bourreaux furent jugés lors du procès de Nuremberg en 1945-1946, mais le tribunal préféra les inculper pour crimes contre l’humanité plutôt que pour génocide. Ce n’est qu’en 2005, à l’occasion du 60e anniversaire de la libération d’Auschwitz, qu’une résolution de l’Organisation des Nations Unies désigna le 27 janvier comme journée internationale de commémoration de l’Holocauste, aussi appelée «Journée internationale dédiée à la mémoire des victimes de l’Holocauste». Dans l’Union européenne, de nombreux programmes sont destinés à perpétuer la mémoire de ces tragédies ayant marqué l’histoire du continent. Le Parlement européen, dès 1995, adopta des résolutions rappelant le devoir de mémoire non seulement par des commémorations, mais aussi grâce à l’éducation. En novembre 2018, l’Union européenne devint un partenaire international permanent de l’Alliance internationale pour la mémoire de l’Holocauste (AIMH). On 7 January 2019, the European Commission presented two proposals for amendments to the legal instruments of the EU information systems following the adoption of Regulation 2018/1240 on the establishment of a European Travel Information and Authorisation System (ETIAS). The ETIAS Regulation requires all visa-exempt non-EU nationals to apply online for travel authorisation prior to the date of their departure. Neither the original Commission proposal for ETIAS, nor the two subsequent proposals (‘the Commission package’) were accompanied by Commission impact assessments. The European Parliament’s Committee on Civil Liberties, Justice and Home Affairs (LIBE) therefore requested a targeted substitute impact assessment of the expected fundamental rights impacts of specific elements of the Commission package. In particular, this study assesses: 1) whether the amendments to the ECRIS-TCN Regulation provided for in the Commission package extend the scope of that information system and, if so, whether such an extension is necessary and proportionate in accordance with Article 52(1) of the EU Charter; and 2) whether the amendments regarding the automated processing of ETIAS application files through comparisons against data present in EU information systems raise concerns in relation to the rights to respect for private life and protection of personal data.
