Fact-finding visit to Bulgaria

The PETI Committee decided to organise a fact-finding visit to Bulgaria as a result of a relatively large number of petitions it has received from Bulgarian citizens on the Bulgarian Code of Civil Procedure (CCP). The PETI Committee decided to organise a fact-finding visit to Bulgaria as a result of a relatively large number of petitions it has received from Bulgarian citizens on the Bulgarian Code of Civil Procedure (CCP). Petitioners allege breaches of consumer rights, corruption, the role of bailiffs, violation of the right to a fair trial, and breaches of Directive 93/13/EEC on unfair terms in consumer contracts. The aim of the visit is to hear the petitioners and to investigate and discuss the subject matter of the petitions with the Bulgarian authorities.

Durante la legislatura 2014-2019 l'Unione europea, e in particolare il Parlamento europeo tramite l'apposita commissione per le petizioni (PETI), ha continuato a garantire il diritto dei cittadini di presentare una petizione al Parlamento europeo per sollevare questioni e preoccupazioni e chiedere di avviare una procedura di ricorso in ambiti di competenza dell'UE, mobilitando le istituzioni e gli Stati membri sia su temi al centro del dibattito politico che su questioni "orfane" o "dormienti". ...

Durante la legislatura 2014-2019 l'Unione europea, e in particolare il Parlamento europeo tramite l'apposita commissione per le petizioni (PETI), ha continuato a garantire il diritto dei cittadini di presentare una petizione al Parlamento europeo per sollevare questioni e preoccupazioni e chiedere di avviare una procedura di ricorso in ambiti di competenza dell'UE, mobilitando le istituzioni e gli Stati membri sia su temi al centro del dibattito politico che su questioni "orfane" o "dormienti". Per assicurare un miglior servizio ai cittadini dell'Unione, la commissione ha creato un portale web delle petizioni allo scopo di agevolare la presentazione delle petizioni, consentire una maggiore interazione e fornire servizi di informazione. Ha inoltre adottato nuove linee guida aggiornate per semplificare il trattamento delle petizioni e il relativo processo decisionale, ed è riuscita ad apportare modifiche migliorative al regolamento del Parlamento europeo. La collaborazione con le altre commissioni del Parlamento europeo è diventata più intensa e proficua, anche grazie alla creazione di una rete di petizioni. Per la prima volta, la commissione PETI ha istituito uno speciale gruppo di lavoro sulle questioni relative al benessere dei minori, incaricato di esaminare alcune petizioni sui diritti dei minori e di riferire alla commissione proponendo raccomandazioni. La commissione PETI ha mantenuto buoni rapporti di lavoro con la Commissione, il Consiglio, gli Stati membri e il Mediatore europeo. Ha collaborato fianco a fianco con i servizi del Parlamento europeo, soprattutto con il Servizio giuridico; inoltre, ha incrementato in misura esponenziale il ricorso alle competenze di ricerca sia del dipartimento tematico Diritti dei cittadini e affari costituzionali (per preparare studi e seminari) sia del servizio Ricerca del Parlamento europeo (EPRS). Nel corso della legislatura 2014-2019 ha anche organizzato un numero significativo di audizioni pubbliche. Peraltro, dal confronto tra il numero di relazioni, pareri, interrogazioni con richiesta di risposta orale, risoluzioni e missioni d'informazione delle legislature 2014-2019 e 2009-2014 si evince che la commissione è riuscita anche a mantenere sostanzialmente stabile l'ordinaria attività parlamentare (cfr. allegato I). In tale contesto, la commissione per le petizioni ha continuato a esaminare un numero elevato di petizioni su temi che interessano tutti i settori di attività dell'Unione europea: diritti fondamentali, migrazioni, diritto di petizione, cittadinanza, libera circolazione, discriminazione, iniziativa dei cittadini europei (ICE), diritti dei minori, ambiente, benessere degli animali, disabilità, politiche sociali e occupazione, Brexit, miglioramento della legislazione e applicazione del diritto dell'UE, apertura, trasparenza, accesso ai documenti, conflitto di interessi, accordi internazionali. La commissione PETI si è inoltre occupata di temi estremamente specifici, ad esempio della legislazione ipotecaria e degli strumenti finanziari di rischio, e si è dedicata in modo particolare al tema della disabilità, in ragione dell'importante ruolo che riveste nell'identificazione delle violazioni dei diritti delle persone con disabilità (il cosiddetto "ruolo di protezione" nel quadro dell'UE istituito per attuare la convenzione dell'ONU sui diritti delle persone con disabilità a livello dell'Unione e degli Stati membri).

FEMM Mission to Italy - 17-19 December 2018

The FEMM Committee requested the Policy Department for Citizens’ Rights and Constitutional Affairs to provide a briefing for a mission to Italy (17-19 December 2018). The focus of this FEMM mission is on conscientious objection to abortion in Italy and the trafficking of migrant women for prostitution in Italy. This briefing provides background information on both subjects.

The role of ombudsmen and petitions committees in detecting breaches of EU law

Over the last decades, national and EU political institutions have sought ways to get closer to citizens, who are showing an increasing dissatisfaction with the performance of democratic institutions. The right to petition and the right to submit complaints to ombudsmen (the twin rights) can be considered two privileged instruments for strengthening this relationship, since they are two of the most accessible ways for citizens to address political institutions, notably to react to the application ...

Over the last decades, national and EU political institutions have sought ways to get closer to citizens, who are showing an increasing dissatisfaction with the performance of democratic institutions. The right to petition and the right to submit complaints to ombudsmen (the twin rights) can be considered two privileged instruments for strengthening this relationship, since they are two of the most accessible ways for citizens to address political institutions, notably to react to the application of EU law and policy. Pioneering efforts have been made to enhance the relationship with the citizens, notably through the use of new technologies. These technologies facilitate the exercise of the twin rights, they democratise access to information or facilitate communication between institutions and citizens. One of the major shortcomings in the petitions/complaints process is the lack of knowledge of the profile of those who make use of their right to petition or to complain. This briefing provides some recommendations on how to empower parliaments and enforce citizens’ rights through the petitions and complaints process.
