Il trattato sul funzionamento dell'Unione europea (TFUE) stabilisce agli articoli da 101 a 109 le norme sulla concorrenza nel mercato interno. Tali norme vietano accordi tra imprese che siano restrittivi della concorrenza. Alle imprese che si trovano in posizione dominante è vietato sfruttare abusivamente la propria posizione e in tal modo pregiudicare il commercio tra gli Stati membri. Le fusioni e le acquisizioni di dimensione europea sono controllate dalla Commissione europea e possono, in taluni casi, essere vietate. Sono inoltre proibiti gli aiuti di Stato a favore di determinate imprese o prodotti che provocano distorsioni della concorrenza. Tuttavia, essi possono essere autorizzati in taluni casi specifici. Le norme sulla concorrenza si applicano anche alle imprese pubbliche, ai servizi pubblici e ai servizi di interesse generale. Se venisse compromessa la realizzazione degli obiettivi di tali servizi specifici, le norme sulla concorrenza potrebbero essere soppresse.

The presentation essentially covers the areas within the responsibility of the Economic and Monetary Affairs Committee (ECON); hence it starts with core ECON areas but also displays neighbouring areas of other Committees' competences which are closely connected to and impacting on ECON's work. This study provides a graphic overview on core legislation in the area of economic and financial services. The presentation essentially covers the areas within the responsibility of the Economic and Monetary Affairs Committee (ECON); hence it starts with core ECON areas but also displays neighbouring areas of other Committees' competences which are closely connected to and impacting on ECON's work. It shows legislation in force, proposals and other relevant provisions on banking, securities markets and investment firms, market infrastructure, insurance and occupational pensions, payment services, consumer protection in financial services, the European System of Financial Supervision, European Monetary Union, euro bills and coins and statistics, competition, taxation, commerce and company law, accounting and auditing. Moreover, it notes selected provisions that might become relevant in the upcoming Article 50 TEU negotiations. This document was provided by Policy Department A on request of the ECON Committee.
