Research for PECH Committee - Seafood Industry Integration in all EU Member States with a coastline

This study researched the drivers and mechanisms of both structural and non-structural horizontal and vertical integration in the seafood industry in all Member States with a coastline. The objective of the study was to identify trends among the Member States. The observed trends generally fall into three broad, inter-linked categories: regulatory environment, natural resources and firm performance.

Single-use plastics and fishing gear: Reducing marine litter

Most of the plastic in our oceans originates from land-based sources. Most of the plastic in our oceans originates from land-based sources. On European beaches, plastics make up 80-85 % of marine litter, which is considered a major threat to marine and coastal biodiversity. Marine litter also costs the European Union economy an estimated €259 million to €695 million per year. In May 2018, the European Commission put forward a legislative proposal seeking to address the issue of marine litter from plastics. The proposal would introduce a series of measures regarding the top 10 single-use plastics found on European beaches, as well as fishing gear, with a view to reducing their impact on the environment and ensuring a functional internal market. After completion of the legislative procedure, the final act was signed by the presidents of the co-legislators (European Parliament and Council) on 5 June 2019, and published in the Official Journal of the European Union on 12 June 2019. Member States have two years (i.e. until 3 July 2021) to transpose the new directive into national law. The Commission proposal aims to reduce the environmental harm from single-use plastics and fishing gear. The supporting impact assessment (IA) does not discuss the impacts on innovation, research and development or the feasibility for businesses to invest into alternative materials. The IA only briefly touches upon the implications for SMEs and does not explain why the open public consultation ran for 8 weeks instead of the 12 weeks. Unlike the maritime transport sector, there is no single EU standard for the training and certification of fishers relating to health and safety on board. Member State safety training and certification requirements for fishers are complicated and vary significantly between Member States. This complexity is an obstacle to the free movement of fishers and it makes it harder to comply with statutory training and certification requirements. The European Parliament and Council have adopted a regulation concerning the conservation of tuna and tuna-like species, and the management of fisheries targeting these stocks in the Atlantic Ocean (including adjacent seas such as the Mediterranean). The new regulation, which entered into force on 3 December 2017, transposes into EU law a number of binding recommendations adopted by the International Commission for the Conservation of Atlantic Tunas (ICCAT), a regional fisheries management organisation to which the EU is a contracting party. These measures needed to be enacted in EU law to become applicable, notably to operators such as the masters of fishing vessels. When adopting its legislative resolution, the EP also voted on a statement to express its concern at the Commission’s delay in proposing to implement ICCAT recommendations (some dating back to 2008), and urged it to send future proposals for transposition of RFMOs' recommendations within six months of the date of their adoption.

La Commissione europea ha proposto di includere alcune raccomandazioni vincolanti della Commissione internazionale per la conservazione dei tonnidi dell'Atlantico (ICCAT) nel diritto dell'Unione europea, nella misura in cui non siano ancora state integrate. In seguito ai negoziati interistituzionali, il Parlamento europeo deve ora votare un progetto di regolamento che stabilisce misure relative alla pesca nella zona ICCAT al fine di raggiungere un accordo in prima lettura.

La Commissione europea ha proposto di includere alcune raccomandazioni vincolanti della Commissione internazionale per la conservazione dei tonnidi dell'Atlantico (ICCAT) nel diritto dell'Unione europea, nella misura in cui non siano ancora state integrate. In seguito ai negoziati interistituzionali, il Parlamento europeo deve ora votare un progetto di regolamento che stabilisce misure relative alla pesca nella zona ICCAT al fine di raggiungere un accordo in prima lettura.

Following the approval, in June 2017, of the outcome of interinstitutional negotiations by the Committee on fisheries, the European Parliament is due to vote on a proposal for a regulation concerning the conservation of tuna and tuna-like species, and the management of fisheries targeting these stocks in the Atlantic Ocean (including adjacent seas such as the Mediterranean), with a view to reaching a first-reading agreement. This legislative proposal aims to transpose into EU law a number of binding recommendations adopted by the International Commission for the Conservation of Atlantic Tunas (ICCAT), a regional fisheries management organisation to which the EU is a contracting party. To become applicable, notably to operators such as the masters of fishing vessels, these measures must be enacted in EU law. The European Commission is also proposing that future ICCAT recommendations for some fisheries management measures should become part of EU law through delegated acts. Owing to its purpose (transposition of internationally agreed measures), this legislative proposal is not accompanied by an impact assessment and was not the subject of a public consultation. The present note was requested by the Committee on Fisheries of the European Parliament for its Delegation to Japan (18-22 September 2017). The note provides a review of the main characteristics and specificities of Japan fisheries sector and related activities. It provides an overview of issues such as the legal and institutional framework, fisheries management, catches, the fishing fleet, fishing industry, trade, employment, the fish market and marine research.

Labour rights in Export Processing Zones with a focus on GSP+ beneficiary countries

The European Union’s GSP+ scheme provides trade concessions to beneficiary countries and obliges them to ratify and effectively implement key international conventions on human rights and labour rights. The sectoral gains of GSP+ have thus far been concentrated on exports of apparel, textiles and processed fish. Such sectors are often located in Export Processing Zones (EPZs) where the governance of labour rights may differ from the rest of the country and fall below international legal standards ...

The European Union’s GSP+ scheme provides trade concessions to beneficiary countries and obliges them to ratify and effectively implement key international conventions on human rights and labour rights. The sectoral gains of GSP+ have thus far been concentrated on exports of apparel, textiles and processed fish. Such sectors are often located in Export Processing Zones (EPZs) where the governance of labour rights may differ from the rest of the country and fall below international legal standards. This study examines the apparel sectors of Pakistan, Mongolia and Sri Lanka and the processed fish sector of the Philippines. The importance of EPZs to exports under the GSP+ varies by country and sector. Only in Pakistan are EPZs legally exempt from rights relating to freedom of association and collective bargaining. But restrictions on these and other rights in practice remain widespread, and are not confined to EPZs. Efforts to promote labour rights through the GSP+ should focus on key export sectors benefitting from the scheme and consider EPZs alongside other sites of the supply chain where exploited workers are based.

The aim of the study is to provide the Members of the Parliament's Fisheries Committee with a clear description of the corporate structure of the EU seafood industry (fishing, processing and the retail market). It provides a description of both the horizontal and vertical integration in the industry through the use of case studies. The research utilised both quantitative and qualitative research methodologies in order to provide an in-depth and nuanced picture of integration in EU fisheries.

The aim of the study is to provide the Members of the Parliament's Fisheries Committee with a clear description of the corporate structure of the EU seafood industry (fishing, processing and the retail market). It provides a description of both the horizontal and vertical integration in the industry through the use of case studies.
