Een “gedetacheerde werknemer” is een werknemer die door zijn of haar werkgever naar een andere lidstaat wordt uitgezonden om daar op tijdelijke basis een dienst te verrichten. De vrijheid van vestiging en de vrijheid van dienstverrichting behoren tot de fundamentele vrijheden die verankerd zijn in het Verdrag betreffende de werking van de Europese Unie (VWEU). Bepalend voor de status van gedetacheerde werknemers is het beginsel “gelijk loon voor gelijk werk op dezelfde plaats”.
