Swoboda przemieszczania się i pobytu osób w Unii Europejskiej stanowi podstawę obywatelstwa UE wprowadzonego traktatem z Maastricht z 1992 r. Po stopniowym zniesieniu granic wewnętrznych na mocy porozumień z Schengen przyjęto dyrektywę 2004/38/WE w sprawie prawa obywateli Unii i członków ich rodzin do swobodnego przemieszczania się i pobytu na terytorium UE.
