States of emergency in response to the coronavirus crisis: Situation in certain Member States II

Member States have adopted a range of emergency measures in response to the unprecedented public health crises generated by the coronavirus pandemic. Whereas not all Member States dispose of constitutional mechanisms to enable the declaration of a 'state of emergency', all have taken exceptional and far-reaching emergency measures that affect citizens' rights and freedoms as well as democratic processes. These institutional changes and the restrictions imposed on citizens' lives pose significant institutional and democratic challenges. Given their impact on fundamental rights and freedoms and on the normal functioning of democracy, emergency measures need to be carefully examined, matched with adequate legal safeguards, and subject to close democratic scrutiny. This is particularly true in the context of rapid changes of circumstances and in view of new evidence about the evolution of the crisis and its implications. This briefing covers the following countries: Bulgaria, Estonia, Latvia, Malta, Austria, Romania, and Slovenia. It focuses on three key aspects: i) the constitutional framework of the state emergency or legitimation of the emergency legislation; ii) the concrete measures adopted; and iii) the extent of parliamentary oversight exercised on the adopted measures. This briefing is the second in a series aimed at providing a comparative overview of Member States' institutional responses to the coronavirus crisis. The first in the series covered an initial set of seven Member States.

The ECI enables European citizens to invite the Commission to table a proposal for a legal act. The detailed rules for such initiatives are laid down in a 2011 regulation, whose main stated aim is encouraging citizens' participation in the political life of the European Union (EU). However, since the regulation became applicable in April 2012, numerous actors have raised concerns regarding the instrument's functioning and have called for reform, aiming to simplify the existing procedures and increasing the tool's usability. On 13 September 2017, the Commission presented a legislative proposal which would update the tool and replace the existing regulation on the European Citizens' Initiative. Following interinstitutional negotiations between September and December 2018, the co-legislators reached provisional agreement on the proposal for revision of the ECI. The agreed text was approved by the Parliament and Council in March 2019 and published in the OJ in May 2019. The new provisions apply in full from 1 January 2020. The European Union Code on Visas is one of the core elements of the EU's visa policy. It lays down the procedures and conditions for issuing short-stay visas for third-country nationals. On 14 March 2018, the Commission adopted a proposal to revise the Community Code on Visas (the visa code). The main objective of the proposal is to strengthen the common visa policy while addressing migration and security concerns. This will involve increasing the role of visa policy in the EU's cooperation with third-countries, also taking economic considerations into account by facilitating the processing of visas for legitimate travellers who contribute to the EU's economy and its cultural and social development. After Parliament voted its position on the proposal in December 2018, trilogue negotiations brought an agreement on a compromise text in February. The Schengen Information System (SIS) is a large-scale information database that supports external border control and law-enforcement cooperation in the Schengen states by enabling competent authorities, such as police and border guards, to enter and consult alerts on wanted or missing persons and lost or stolen property. In view of responding more effectively to new migration and security challenges, in December 2016, the European Commission put forward a package of three legislative proposals aimed at revising the legal framework of the SIS. The proposal on the establishment, operation and use of the SIS in the field of border checks provides for more effective use of fingerprints and facial images in the SIS, and imposes an obligation on the Member States to record all entry bans issued to thirdcountry nationals who have been found staying illegally in their territory. In view of responding more effectively to new migration and security challenges, in December 2016, the European Commission put forward a package of three legislative proposals aimed at revising the legal framework of the SIS. The proposal on the use of the SIS for returning illegally staying third-country nationals aims to enhance the enforcement of the EU return policy and to reduce the incentives to irregular migration to the EU.
