Voľný pohyb kapitálu nie je len najnovšou zmluvnou slobodou, ale vďaka svojmu jedinečnému rozmeru zahŕňajúcemu tretie krajiny je aj slobodou najrozsiahlejšou. Liberalizácia kapitálových tokov prebiehala postupne. Na základe Maastrichtskej zmluvy boli odstránené všetky obmedzenia pohybu kapitálu a platieb medzi členskými štátmi, ako aj medzi členskými štátmi a tretími krajinami. Táto zásada má priamy účinok, t. j. nie sú potrebné žiadne ďalšie právne predpisy na úrovni EÚ ani členských štátov.
